Hi all,is it now illegal to sell mod chips for the ps2 ? i have been informed this is the case since a high court ruling by Mr Justice Laddie.

In all countries who have passed the DMCA or EUCD laws it is illegal (but most have not done anything about it... but this will be a matter of time...)

hey empire havent seen you on the ps2 forum for a while. In italy modchipings not illegal. The only 2 countrys i know that are illegal are Belguim and the uk (usa to come)

beacause it was a court case with sony not microsoft. Microsoft havent taken modchippers to court yet.

Well, lets hope if it does happen, (probably will because this country sucks), Microsoft lose and therefore that creates a loophole to use the PS2 mods...

Microsoft cant take modchippers to court cz when you buy a xbox modchip it comes with a legal bios that doesnt allow to play backups, it only allows you to install linux in it. after u get the modchip you have to download bios from internet and flash th modchip so you can play backups.

Technically, can't we do something similar with chips in this country? Ship them blank and the mod companies should release an import only booting software and then people can change the code and allow them to play backups like the hacked cromwell BIOS on the 'Box???

Yes but they still can regard the chip as a "tool" to hack copy protected matierial. There is probably a reason why M$ isnt using that reason to sue.

you can buy blank ps2 chips here {english in top rigth corner} and then flash them with ice code. But if you'rew in the UK as soon as you flash then woth ice code they will become Illegal.

It's obtaining that's the problem. If you could GET them, they can't really do ****, so they have to stop you getting them, and if they only have say software to boot imports instead of backups and imports, then they can't really say **** - as it's the end user who is hacking the chip, and the chip itself is not the illegal matter

Well i feel sorry for people in the uk...here is australia modchipping is legal...sony took some guy in sydney to court for installing modchips from memory the judge said that if a person buys said product (PS2), it becomes their (buyers) property and can do whatever they want..but I think sony are appealing the decision or they have appealed and lost (it happened in 2002)

Sony has failed persuade an Australian Federal Court that using modification chips necessarily violates copyright laws.

Honourable Justice Ronald Sackville ruled that Sony had failed to establish that mod chips constituted a "technological protection measure" that protected the copyright of its games software. If mod chips don't protect copyright then selling them does not violate copyright laws, he reasoned.

On this narrow basis the judge rejected the console maker's claim for damages against Sydney businessman Eddy Stevens for supplying mod chips. Stevens, however, was seperately found guilty of selling pirated games.

Although the ruling is been seen as a victory for PlayStation owners who use mod chips to play games bought outside Australia, the case merely establishes a lower threshold for what can be seen as effective copyright protections measures.

This is narrow victory for mod chip users, and one achieved , judging by the court documents, mainly made because Sony messed up the presentation of its case.
