Well technically no, you can flash the bios at any time. You just can't read a disc in the drive till you do.
It looks like people are selling hacked drives for 145 bucks! Geez, I could make a killing selling them for 70  Yeah, I just need to check with a lawyer or something.

IT all depends on the terms of use. I mean, a lot of companies don't really care if you distribute firmware, since alot of the time they are distributing updates, or hacked firmware that makes the pc drive better in some way. I am not so sure it is the same for xbox though.
