I was able to succesfully copy the Max Payne CD this way:
first, simply copy the entire content of the cd into a folder on your hard drive, except for the direct x folder, which isn't needed. This will have all the files you need, and all of the data is small enough to fit on a standard cdr. Next, just make a data cd with the contents of the folder. It sounds strange, but it works, the cd works to install, but you will still need the no-cd patch. This process worked fine for me. To make it even handier, you can just toss the no-cd patch in the mix while making the cd.
