I can only talk about Germany: One will still be allowed to make a backup of an original CD, as long as it is not copy-protected, cos circumventing the protection will be illegal. Thus, cd-duplicators like clone (like it is atm) will also become illegal, as they circumvent the protection. Generally there will be no need for a duplicating prog, as a simple "copy to hd, then burn" with a pure burning prog (like nero) will do for unprotcted cds.....

yeh i´ve heard this before...
this tool will be illegal in germany. [i only use it for burning vcds / svcds, no games...] @monty: soon a personal backup isn´t allowed anymore in .DE

Monty, how does CloneCD circumvent the protection?
If Clone makes 1:1 copies of CD's as their site says, then the copy is still protected with the same copy protection mechanism as the original and thus has not circumvented the protection but reproduced it so the copy acts exactly like the original, how can they say that is circumventing? I understand circumventing to mean 'avoiding' and Clone doesn't 'avoid' the protection, it keeps it. That's how I understand it anyway ![]() I think Clone is still being worked on though, I took this quote from CDFreaks.com: Quote:

There's a EU directive that's getting put into law in ALL EU countries, which, unfortunately, includes mine <snif> This new german law is probably based on that directive. It's completely retarded, however there's no guarantee that it'll ever be really effective. Like the DMCA in the USA, this directive tramples over certain basic consumer rights like fair use, and I'm not 100% sure anyone will ever be prosecuted on the basis of this new law. However, in the USA the DMCA has never been put to the test in the court of law. That's because a) it's on shaky grounds concerning consumer rights and most importantly b) it contains several wide ranging and rather bizarre powers granted to copyright holders, like the ability to subpoena identities of copyright infringers without a court order or the ability to shutdown ANY website for any imagined reason for two weeks.
This law has been used wide and far to silence critics, shutdown x-box mod sites, and even to prohibit companies from making Lexmark compatible inkt cartridges. Despite all this legal thuggery, the DMCA has not been tested in a court of law yet. So I don't think this new dumb copy of one of the USA's worst laws of the past 100 years will truly get enacted. But we will probably get harassed more and more by Cease and Desist letters from the devil's own lawyers. Because after all it's not necessary for copyright holders to risk a real court case if they can use threats to shut ANYONE down on even the flimsiest excuse. And who will have the money and the energy to stand up in court and fight against these bozos ? I know I don't. However I can protest in another way. If this law truly begins to interfere with my godgiven right to make a backup, I will stop buying games at all. I don't care if anyone else does this, the important thing for me is that I have a line drawn WHICH WILL NOT BE CROSSED. |

Eagle, I see your point now! Clone doesn't use mdf's but the 'emulate weak sectors' could be taken to be 'circumventing' so can 'Hide CDR Media' but can 'amplify weak sectors' be considered 'circumventing' too? Doesn't that still create a CD that's copy protected? Or could that be deemed 'modifying' and hence breaking the EULA if the company expressly forbids 'modifying'. DrA. |

Hi. I think i must write here. It's a pity for everybody the end of the CloneCD development, but will be another programs to try when CloneCD disappears. Here in Spain laws are getting really incredible dor most users. The last one was the p2p discussion. Now here in Madrid, justice tribunals are seeking a way to send for 4 years to prison that p2p users that downloaded a high amount of data ( that is supposed to be gamez,moviez,appz,etc..but not tested). And to finish, in September a new law will criminalize every user that owns any program that "unprotect" any kind of protection ( CSS for example).
Here in Spain we are getting really in trouble, and there is only a escape way for us. We were really very far for that hacker/cracker way of thinking, but now, every user is a potential criminal so we are thinking to fight to this with certain "illegal" actions. I have a backup web page and like most users will teach people to unprotect programs from now to forever. Will do that legally (not secret) or illegally ( encrypted conections) but i'm not ready to accept that f***ing way of ruling us for the interest of only a few ones. Download,sharing and copying is not a crime to be pursued for if you don't take any profit for it. Thx for readind that.
