HELP with DIABLO 2 v1.09 fixed exe patch

I've installed Diablo 2 from a backup copy of the CD. I did the full installation. I applied the v1.09 patch. And then I downloaded the file archive as per the instructions and extracted game.exe to the diablo 2 directory.

In spite of this, I am still unable to play the game. The game still requests the play CD to be in the CD ROM, even though I have the play CD (or rather, the backup copy of it) in the CD ROM. Can anyone lend me some advice as to how to fix this?
