In order to access battle.net, you HAVE to use the CD. When you log on, it checks your current version, and then verifies your cd-key and it can't do that without the CD installed. I suggest using Clone CD to burn a 1:1 working copy if your burner will support it. If not, either find one that does or just go and buy the game.
