if you can aquire a copy from elsewhere,ie a friend etc..it would still be legal as you own the game.
Hmm, this statement is questionable!
No-one ever owns the game, they own the license to play the game on one machine at a time. Being allowed to create a backup of your own game does not mean getting a copy of your friends game 'etc'. I certainly hope your are not saying it is ok to download a copy if you already own the game? As this is not true.
Each EULA is different, not all allow you to create a backup.

If the disc is scratched try cleaning it with toothpaste or car polish. There is good thread here about cleaning and repairing scratched discs.

Thanks Grumpy...I will try that, I know I didn't pay full price for it...(Lucky me...LOL), but I didn't know if I could copy the disk or not with the scratches, I will try the tooth paste or car polish....I have another question now, why do they not say "You are only buy a license to play" on the box, it is very misleading to purchase a game, only to find out once you open it that it is not actually yours. I may be missing the point here, but if I pay for the item, that particular copy should by all rights be mine to do with as I please, unless otherwise stated on the box at the time of purchase. Because once you get the game home and go to install it and realize that the EULA has a clause that you don't really own the game, but a license there of, is completely false advertisement. That portion of the contract should be on the box, simple as that. That was gamers have a real option to purchase or not to purchase. Sorry about my rant, I just don't understand EULA's that want you to purchase a new game if for say, your disc breaks, you should have the express right to copy that game, so not to damage the original.

I am done ranting....thanks for the advice on the scratches though

As I have said before, each Eula can be different in some parts.
Some publishers will actually replace your damaged disc, free of charge, if the damage is thru no fault of yours and happens in the first 12 months of purchase. What exactly they mean by 'no fault of yours' can also be very questionable! You also have to supply proof of purchase and in some cases you have to post the damaged disc back.
Most others will replace a damaged disc at a small price to cover postage and handleing costs.
Not all Eula's will allow you to create a backup! It really does pay to read the Eula for each game or software you are about to use or install.
And yes, it has always been the same argument that you are not allowed to return a game after opening the seal on the box, yet the Eula is not readable until you actually go to install the game! So Yes I have always stated that the Eula should be printed on the box or you should be made to read and sign it before you actually are allowed to purchase.
Use Google and search for 'Eula', there are quite a few interesting articles on the subject.
