Hi,
I wonder if you've used the cheat mode startup batch file to get access to the console in the game (It might just bypass the error ur getting), I'll mail you a batch file i made to use the cheat console, Simple press f12 to toggle the console and as a bonus, Here's a cheat code to type (If you get it working) Coder =Full weapons & God mode <Copy the "Max".Bat file into your max payne directory & double click it to run>
