It's not a copy right protection it's a copy protection, the extra layer absorbs the scratches so the disk won't be effected, it makes them last longer. You need a really deep scratch that will cut through the black layer and the source layer of the disk to ruin it, this does happen but most disk scratches are just from setting it down which the extra layer was added to protect from, Sony knew kids would be handling these disk and wanted to make sure that the games would last longer then a regular CD.
