Pack the system back up in its original packaging and take it back to the store you bought it at. If you bought it at a good discount store, most have a 90 day return policy. If you bought it at a crappolla store then your probably screwed with my advise.
As for the game, put it up for sale on E-bay or better yet on a good free local site if your area has one and ask $25 for it. I'm guessing it would sell within a week.


P.S. If you keep the system, there might be some good multiplay sports games that might pop up in the mean time while waiting for the good games to come out, that is if you like sports. There might also be some old classics on X-box lives marketplace for 4 players. If you can live without 4 player games then Xbox 360 has a few games that are slightly better than medeocore in my opinion, that are out right now. Like Oblivion, Burnout Revenge, Fight Night Round 3, GRAW, The Outfit, Blazing Angels, and Call Of Duty 2. But for the most part I'd have to agree with you that the 360's Summer lineup is sorta weak. I also heard that Gears of War has been pushed back to a Fall release date or possibly further. I wish they would make something out of the ordinary for the system, like a guitar Hero 2 or a Karaoke Revolution 2, that would make multiplay on one 360 console much more entertaining in my opinion, but then again those types of games get old just about as fast as any other.
