The DL Patcher is a good piece of software, but I believe the later versions of the Infinity software recognise DL backups without being patched.
As for being able to tell if your infinity is real, try to toggle some of the options in the Configuration menu - and reboot. If everything is saved and the system reboots fine, then chances are you have a real Infinity, but the only REAL way to tell is to flash that Infinity
(or open your console and look).
