Hmm, this statement is questionable!
No-one ever owns the game, they own the license to play the game on one machine at a time. Being allowed to create a backup of your own game does not mean getting a copy of your friends game 'etc'. I certainly hope your are not saying it is ok to download a copy if you already own the game? As this is not true.
Each EULA is different, not all allow you to create a backup.

If the disc is scratched try cleaning it with toothpaste or car polish. There is good thread
here about cleaning and repairing scratched discs.
