It is true that the BIN file contains the copy protection, but that doesn't mean that's ALL it contains. Tons of games have .EXEs that contain both the copy protection scheme and many functions of the game itself.
Put it this way... if that BIN file doesn't affect anything other than the copy protection, then it's the worst patch ever created, because not a single thing in the list of fixes for the patch is fixed.

Yes its possible the bin contains other things. Looking at the other files it seems much of the game information may indeed be in this file. A good way to test this is for someone to install the patch and watch the directories as the patch is patching and seeing what files besides the .bin and the language files is changed. /common/misc is a candidate.
Unfortunately I don't forsee anyone releasing a fix to this problem because most people believe (especially the crackers) that an image works for all patches... but this is simply not true. In other words... don't hold your breath.
