Yes it is unfortunately, as your brother bought it for his machine.
And he agreed the EULA, which states one copy per machine.
So for you to play it you will need to purchase one, even if the anti-piracy groups dont care if you did or not and wouldnt bother taking you to court, the means is the same as a big time pirate anyways.
Alot of people get caught out on this, they think when a friend allows them to borrow their game, people think by putting on a no-cd they are allowed to play the game, when it is very not true.
