I donno anything about DMS3’s, I don’t install them, The cost would be too much. I would think for the price you’d be able to load a new TOC without any problems. Possible bad wiring or incompatible function with some PS2 versions.
If you are stuck with a chip that will not swap it may be possible to add a switch to reset the chip as you close the tray with a new CD. A mod chip reset should force the chip to re-inject the license code to enable a new TOC to load. The easiest way may be to cut the power to the chip and turn back on as the tray is closing. May cause damage though, or crash the board from the bios patching.
