BF1942 1.6 server.... without cd key checks?

NO!
When you have a legit game you will also have a legit cd-key !!!
If your cd-key not working, ask the publisher (EA) for a replacement.

Because of the way you worded your question, I am assuming that you are trying to host a server that does not check keys. I don't see anything wrong with doing that.
