The problem is that there are hoardes of, well not fools - but not exactly now best placed, shall we say, who are clogging up the fitting works with NEO4 installs. So I can't get two PS2s fitted with origaChip!

I'm not surprised that NEO4 might have problems with Sony because it won't play import originals - which OrigaChip and Messiah do - so there are potentially different issues for the NEO4 to face in legal terms.

I suppose that Sony are entitled to protect their own code and if Messiah and Origa can show that they have not used any portion of Sony protected property and if Neo4 can show that it is reasonable for people to make backups of their originals and imports, then they'll come out of it all right.

If Sony take injunctive action, then it could be beyond the financial means of some modchip developers to fight it through and they'd have to stop trading. Sony do have the financial muscle to work in this way, but they have to convince the courts that an injunction is warranted and if they subsequently lose in the full hearing, they'd have to pay out millions. Sony might not be afraid of this because they might fancy their chances of breaking their opponents financially before they could win in a full hearing.

This is what headlines the ChannelTechnology website:

"Due to recent legal proceedings by Sony towards our sale of the Messiah chip we have decided to remove it, and all Sony related devices from the website.
We were eager to promote this device, which arguably had a legal side (we may still yet have to fight on this, depending on their actions). Our main argument (which is received from reading court actions of something similar), was to be that the Messiah could in fact play imported games, this is a GOOD argument, and although we possibly should have been more restricted in advertising it's other capabilities. The rest of the argument is that because our Eastern colleagues do not have access to (and THEY would never give) their patented media-authoring technology, they could not make something that could decipher the media. Therefore, if the original imports played, everything else played... it was just part and parcel of the design.

There are many other arguments also that could be implemented, and until we find out what our situation is by having technical legal advice, then we should reserve judgment on these for now, but the situation is that legal advice at this stage is definitely necessary due to the intense continuous flow of pressure that we receive (this is an almost daily flow / stream of information that shows we are to be 'crushed').

Having taken legal advice today, we were advised to fight, but be sure, we are 'hammered' continuously, and personally myself, I have had to run around like a headless chicken to stay ahead of this one, and it's tiring ! But it begins to appear that we are cornered, so will be forced to come out fighting, if this is the case then so be it, Channel Technology is the stakes on the table, so when you see a 404 message appear here, you know the score !

When we get in front of the people that listen, we will be sensible, and clear in our arguments, the opposition will make us appear to be the scum of the earth, and maybe in many peoples eyes we are ??. Hopefully we will not have to get that far, this factor is now not our decision.

But on a personal note let me just say...

We do not have a bottomless wallet, and having never had to deal with these 'civil' matters before, today I was advised that my ability to fight is dependant on the depth of my wallet by my council, therefore already it's like I have to fight by getting in the ring and take-on the likes of Mike Tyson !

I'm probably going to get knocked out in round 1, but as weak and weary and damaged I may be, I'll walk away with my chin high and proud

Playstationmods have posted the following on their website which is otherwise closed:

"Due to recent legal proceedings by Sony towards our sale of the NEO4 chip we have decided to close down all our modchip operations indefinitely.
At the end of the day we work hard on our main games and repairs businesses and it is simply not worth jeopardizing our staffs futures just to do modchips. This is the first time we've been asked to stop supplying modchips by Sony and we will comply without reservation and without prejudice.

Our new online Console Spares & Repair / DVD Player / Games & Gadgets shops will be open in the new year.
